These Terms & Conditions govern your use of the Scotland Stock website and the purchase of footage from Scotland Stock.
By using the website or purchasing footage, you agree to these Terms & Conditions and to the Scotland Stock Licence applicable to your purchase.
1. About Scotland Stock
Scotland Stock is a curated library of professionally filmed footage, made available for licensing for creative and commercial productions.
Every clip is personally reviewed before publication. Scotland Stock aims to provide high-quality footage with clear and straightforward licensing.
Scotland Stock is currently operated as a trading name of Scott Remy, a sole trader based in Scotland.
This information will be updated if Scotland Stock is subsequently operated through a separate legal entity.
2. Using Scotland Stock
You may browse, search and use the Scotland Stock website for lawful purposes and in accordance with these Terms.
You must not:
- Attempt to gain unauthorised access to the website, its systems or storage infrastructure.
- Circumvent or interfere with download restrictions, security measures or access controls.
- Use automated systems to scrape, copy or systematically collect footage, previews, metadata or other website content.
- Attempt to obtain footage without purchasing the applicable licence.
- Use the website to distribute malware or other harmful material.
- Interfere with the operation or security of the website.
- Use the website for any unlawful or fraudulent purpose.
Scotland Stock reserves the right to restrict or refuse access where it reasonably believes the website is being misused or these Terms are being breached.
3. Footage purchases
Footage is purchased on a per-clip basis.
The price displayed on the Scotland Stock website is the base price applicable to that footage, in pounds sterling (GBP). Dollar and euro amounts, where shown, are approximate conversions for guidance only and are not the amount payable. Where VAT or other applicable taxes are due, these will be calculated during the checkout process based on the customer’s location and added to the order where applicable. The applicable VAT or tax amount will be shown before payment is completed and on the order confirmation.
Prices may change in the future, but changes will not affect purchases that have already been completed.
Scotland Stock reserves the right to correct pricing, description or availability errors before an order is accepted.
A purchase is completed when payment has been successfully processed and an order confirmation has been issued.
4. Payment
Payments are processed securely through Stripe.
Scotland Stock does not store your full payment card details.
By submitting payment, you confirm that you are authorised to use the payment method provided.
If a payment is declined, reversed or otherwise not successfully completed, the footage licence will not be considered purchased until payment has been successfully received.
5. The footage licence
Your use of purchased footage is governed by the Scotland Stock Licence.
The Licence forms part of your purchase agreement and sets out what you may and may not do with the footage.
The licence is granted to the individual or organisation making the purchase and is subject to the applicable Standard or Production Licence.
Purchasing footage does not transfer copyright or ownership of the original footage.
Where these Terms and the Licence appear to conflict in relation to the permitted use of footage, the Licence will govern that use.
6. Download and delivery
Purchased footage is provided as a digital download.
Following successful payment, Scotland Stock will provide download instructions or a download link to the email address supplied during checkout.
Purchased footage may be re-downloaded without additional charge and download access is intended to remain available indefinitely, subject to the continued operation of Scotland Stock.
Scotland Stock may change the systems or storage providers used to deliver downloads. If a previous download link stops working, customers may email orders@scotlandstock.com directly.
7. Download security
Download links may incorporate security measures designed to prevent unauthorised sharing or redistribution.
Customers must not attempt to bypass these measures or deliberately make download links or original footage available to unauthorised third parties.
A download link is provided for the purchaser’s use in connection with their licensed footage.
8. Defective or incorrectly supplied footage
Scotland Stock makes reasonable efforts to ensure that files are correctly prepared and supplied.
If a purchased file is corrupted, defective, materially different from the footage described, or supplied incorrectly, please email orders@scotlandstock.com.
Where appropriate, Scotland Stock will investigate the issue and may provide a replacement file or, where a suitable replacement cannot reasonably be provided, a refund.
This does not affect any statutory rights that cannot legally be excluded or limited.
9. Refunds and cancellations
Refund requests are considered on a case-by-case basis. Refunds are not generally guaranteed once footage has been downloaded, including within 14 days of purchase, subject to applicable statutory rights.
Where a file is defective, corrupted, materially different from its description or otherwise supplied incorrectly, Scotland Stock will work with the customer to provide a suitable resolution, such as a replacement file or, where appropriate, a refund.
Nothing in these Terms limits or excludes any consumer rights that cannot legally be limited or excluded.
10. Removal or withdrawal of footage
Scotland Stock may remove footage from the website or stop offering particular footage for licensing at any time.
If footage is removed after you have purchased it, your existing licence will normally remain valid and unaffected.
However, if continued use of particular footage becomes legally impossible or would expose Scotland Stock or the customer to a significant legal issue, Scotland Stock may contact affected customers and take reasonable steps to address the situation.
Where appropriate, this may include offering a replacement clip or refund.
11. Website content and intellectual property
The Scotland Stock website, including its design, branding, logo, text, graphics, metadata, previews and other original website content, is owned by or licensed to Scotland Stock and may not be copied, reproduced or commercially exploited without permission.
The separate copyright and licensing terms applying to purchased footage are set out in the Scotland Stock Licence.
12. Availability and website changes
Scotland Stock aims to keep the website available and operating reliably but cannot guarantee uninterrupted availability.
The website may occasionally be unavailable due to maintenance, technical problems, hosting or storage issues, security measures or circumstances outside Scotland Stock’s reasonable control.
Scotland Stock may change, update, suspend or discontinue parts of the website or its services where reasonably necessary.
Where practical, Scotland Stock will take reasonable steps to minimise disruption.
13. Errors and content information
Scotland Stock takes care when preparing footage descriptions, technical information, previews and other content.
However, occasional errors or omissions may occur.
If Scotland Stock becomes aware of a significant error affecting a purchase, it will take reasonable steps to correct the issue.
Clip descriptions, technical specifications and other information are provided to help customers assess footage before purchase. Customers should email hello@scotlandstock.com if they require clarification about a particular clip or intended use.
14. Customer responsibility
You are responsible for ensuring that your use of purchased footage complies with the Scotland Stock Licence and applicable law.
In particular, you are responsible for determining whether your particular production requires additional permissions, clearances or consents relating to people, property, locations, trademarks, artwork or other material depicted in the footage.
Scotland Stock provides release information and usage notes where relevant, but the absence of a note does not guarantee that no additional permission will ever be required for a particular use.
15. Liability
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
Scotland Stock will take reasonable care in providing the website and footage, but does not guarantee that the website will always be available or that every service will operate without interruption or error.
To the extent permitted by law, Scotland Stock will not be responsible for losses that arise from:
- Use of footage outside the scope of the applicable Licence.
- Failure to obtain permissions or clearances required for a particular production or use.
- Changes made to footage by the customer or third parties.
- Losses arising from circumstances outside Scotland Stock’s reasonable control.
- Indirect or consequential losses that were not reasonably foreseeable.
Nothing in these Terms affects the rights of consumers or any other liability that cannot legally be excluded or limited.
16. Licence breaches
If you use footage outside the scope of the applicable Licence, Scotland Stock may require you to stop the unauthorised use and, where appropriate, obtain the correct licence.
Serious or deliberate misuse, including unauthorised redistribution, resale, extraction or use of footage outside the applicable licence, may result in further action to protect Scotland Stock’s rights.
17. Privacy
Scotland Stock collects and uses personal information in accordance with its separate Privacy Policy.
This may include information such as your name, email address, billing information and purchase history where necessary to process orders, provide downloads, provide customer support and meet legal obligations.
Payment card details are processed by Stripe and are not stored directly by Scotland Stock.
18. Changes to these Terms
Scotland Stock may update these Terms from time to time.
The version of the Terms in force at the time of a purchase will generally apply to that purchase, unless a change is required by law or expressly agreed otherwise.
The latest version will be made available on the Scotland Stock website.
19. Governing law
These Terms and any dispute or claim arising from them are governed by the laws of Scotland.
Where legally permitted, the courts of Scotland will have jurisdiction over disputes relating to these Terms or purchases made through Scotland Stock.
Consumers may also have additional rights regarding where legal proceedings can be brought under applicable consumer protection law.
